This Privacy Policy explains how Tso Delivery Texas, LLC, doing business as Tso Chinese ("Tso Chinese," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you use our website at www.tsochinese.com (the "Site"), our mobile application (the "App"), and our related online ordering, pickup, takeout, carryout, delivery, catering, customer support, and marketing services (collectively, the "Service").

This Privacy Policy is incorporated by reference into our Terms of Use. It describes our privacy practices but does not itself create blanket consent to all data processing. Where we rely on consent, such as for precise device location or recurring automated marketing text messages, we request that consent separately through the applicable permission or opt-in process.

Service area. Tso Chinese provides ordering, pickup, takeout, carryout, delivery, and catering services only within supported areas in Greater Austin, Texas. Our Site, online content, and advertising may be viewable outside that area, but viewing the Site does not mean that we offer services in your location.

1. Personal Information We Collect

Information you provide

We may collect the following information when you create an account, place an order, request catering, communicate with us, or otherwise use the Service:

• Contact and account information, such as your name, email address, phone number, mailing address, delivery address, username, password, saved addresses, and account preferences.
• Order and transaction information, such as items ordered, cart contents, order history, pickup or delivery selection, fulfillment information, delivery instructions, order notes, optional tip or gratuity amounts, prices, discounts, taxes, fees, credits, cancellations, refunds, adjustments, chargebacks, and customer support history.
• Payment information. Payments are processed by payment service providers. We do not store full payment card numbers. We may receive limited information such as a payment token, card type, last four digits, billing ZIP code, transaction identifier, payment status, fraud signals, refund status, and chargeback information.
• Catering and event information, such as company name, event date and location, headcount, dietary requests, and special instructions.
• Communications, such as customer support inquiries, feedback, and other information you submit to us.
• Marketing preferences, such as whether you are subscribed to or have opted out of email marketing and whether you have separately opted in to SMS marketing.

Information collected automatically

When you use the Service, we and our service providers may automatically collect:

• Device and technical information, such as IP address, browser type, operating system, device model, device identifiers, mobile network, referring URL, and language settings.
• Usage information, such as pages and screens viewed, buttons and links selected, searches, cart and checkout events, session information, timestamps, and error logs.
• Location information, including approximate location derived from your IP address and, if you grant device permission, precise location used for service-area checks, address entry, pickup-location selection, fulfillment, delivery routing, and order tracking.
• Cookie and advertising information, as described in Sections 5 and 6.

Information from other sources

We may receive information from:

• Service providers that help us operate the Service, including point-of-sale and online-ordering providers, payment and transaction providers, delivery-orchestration providers, fulfillment and delivery providers, messaging and email vendors, hosting providers, fraud-prevention vendors, and customer support tools.
• Advertising and analytics partners, including Google and Meta.
• Social media platforms or other third-party services when you choose to interact with or sign in through those services.

Sensitive information

We do not require or intentionally solicit sensitive personal information to use the Service, except that we may collect precise device location if you grant permission. You may also choose to include information in an order note, delivery instruction, catering request, or customer support message that could reveal allergies, health information, dietary preferences, religious preferences, or similar information.

We use that information only to fulfill your request, provide support, protect safety and security, and comply with law. We do not intentionally use order notes, allergy information, dietary requests, or delivery instructions to infer characteristics about you for targeted advertising. We do not sell sensitive personal information.

2. How We Use Personal Information

We may use personal information to:

• Provide the Service, including creating and maintaining accounts, determining service availability, preparing and fulfilling orders, coordinating pickup and delivery, administering optional tips or gratuities, supporting catering, and providing customer service.
• Process payments, cancellations, refunds, adjustments, promotions, and credits.
• Communicate with you about orders, fulfillment or retrieval instructions, account activity, security, support requests, and policy changes.
• Send promotional emails where permitted by law and consistent with your preferences, and send recurring automated marketing text messages where you have separately opted in.
• Personalize the Service, including menu content, pickup locations, and promotions.
• Operate, test, debug, secure, analyze, and improve the Service.
• Detect, prevent, and investigate fraud, abuse, payment disputes, security incidents, and unlawful activity.
• Advertise and measure advertising on Google, Meta, and other platforms, as described in Section 6.
• Comply with legal, tax, accounting, regulatory, and contractual obligations; enforce our Terms of Use; and protect Tso Chinese, our customers, and others.
• Evaluate or complete a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.

3. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

• Service providers. These include point-of-sale and online-ordering providers, payment and transaction providers, hosting and infrastructure providers, messaging and email vendors, fraud-prevention vendors, analytics providers, and customer support tools. They receive information needed to perform services for us and are subject to applicable contractual restrictions.
• Payment, fulfillment, and delivery providers. We disclose information reasonably necessary to process payments, administer optional tips or gratuities, prepare and fulfill orders, provide delivery or other fulfillment services, communicate order status, prevent fraud, process refunds or adjustments, and resolve fulfillment or payment issues. The information disclosed depends on the order, payment method, fulfillment method, and services involved. These recipients may include payment and transaction providers, delivery-orchestration providers, delivery-service providers, fulfillment-technology providers, and other vendors that assist with processing or completing an order. They do not receive your full payment card number from us.
• Advertising and analytics partners. These may include Google, such as Google Ads, Google Analytics, and Google Tag Manager; Meta, such as Facebook and Instagram advertising; and other advertising platforms. We may disclose device identifiers, cookie identifiers, event data, campaign information, and hashed contact information for ad measurement, attribution, audience matching, suppression, retargeting, and personalization. See Section 6.
• Professional advisors. We may disclose information to attorneys, accountants, auditors, insurers, banks, and similar advisors.
• Legal and safety recipients. We may disclose information to law enforcement, regulators, courts, or other parties when reasonably necessary to comply with law or legal process, enforce our agreements, investigate fraud or security incidents, or protect rights, property, and safety.
• Business transaction recipients. Information may be disclosed or transferred in connection with a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction.
• Other recipients at your direction or with your consent.

We do not sell personal information for money. Our use of advertising technologies may, under some privacy laws, be characterized as targeted advertising, a sale, or sharing. We do not sell sensitive personal information.

4. Email and SMS Marketing

Email

We may send promotional emails about menu items, specials, catering, promotions, and Tso Chinese events where permitted by law and consistent with your preferences. An email-marketing selection may be preselected during account registration or in account preferences. You may clear the selection before submitting the form and may unsubscribe at any time using the link in a marketing email or by contacting [email protected].

We may continue to send transactional or service-related emails concerning your orders, fulfillment, account, support requests, and security regardless of your marketing preferences.

SMS and text messages

We send recurring automated promotional text messages only if you separately and affirmatively opt in. Consent to marketing texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.

We may send transactional text messages about an order or fulfillment where permitted by law. Carriers are not liable for delayed or undelivered messages.

5. Cookies and Similar Technologies

We and our partners may use cookies, pixels, tags, SDKs, local storage, web beacons, server-side event tools, and similar technologies to:

• Operate login, cart, checkout, payment, security, fraud-prevention, and other Service functions.
• Remember preferences and improve functionality.
• Understand use of the Service, diagnose errors, and measure performance, including through Google Analytics 4.
• Measure advertising, attribute orders to campaigns, build or refine audiences, suppress existing customers from campaigns, retarget visitors, and personalize advertising, including through Meta Pixel, Google Ads tags, and similar tools.

You may limit cookies through your browser or device settings, but some parts of the Service may not function properly if you do. Where required by applicable law, we process legally recognized browser- or device-based privacy signals that we receive.

We may use Google Consent Mode or similar tools to configure Google and other platform tags and to communicate applicable privacy or opt-out signals. Those signals may affect analytics storage, ad storage, ad user data, and ad personalization.

6. Advertising, Analytics, and Ad Measurement

We advertise Tso Chinese through Google, Meta, and other advertising platforms. We and our advertising, analytics, and technology partners may process information such as IP address, device and browser information, cookie identifiers, advertising identifiers, pages viewed, cart events, checkout events, purchase events, order value, and campaign identifiers.

We may use features such as Google enhanced conversions, Meta Conversions API, customer match, custom audiences, advanced matching, or similar tools. When we use these features, we may provide hashed contact information, such as an email address, phone number, or address information, to advertising partners for measurement, attribution, audience matching, suppression, retargeting, or personalization. Hashing converts information into a coded value before transmission, but hashed information may still be personal information under applicable law.

Our Site, online content, and advertising may be viewed outside our service area. Advertising and analytics technologies therefore may collect limited technical, usage, or ad-measurement information from visitors who are outside Greater Austin even though they cannot receive Tso Chinese services there.

You may limit interest-based advertising through your browser or device settings and through controls offered by advertising platforms and industry organizations, including Google Ads settings, Meta ad preferences, the Digital Advertising Alliance, and the Network Advertising Initiative. You may also email [email protected] with the subject line "Targeted Advertising Request." We will apply requests as required by applicable law and, where feasible, to information and systems reasonably linked to your account that we control. Advertising partners may independently retain or process information under their own policies and controls.

7. Location Information

We collect precise device location only if you grant permission. We may use it for pickup-location selection, address entry, service-area checks, fulfillment, delivery routing, and order tracking. You can revoke device-level location permission through your device settings. We may continue to infer approximate location from your IP address.

8. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Creating an account and placing an order require the user to be at least 18 years old. A person between 13 and 17 may browse the Service only with the involvement of a parent or legal guardian.

9. Your Choices and Requests

You may:

• Update certain account information through available account features or request assistance by email.
• Request access to, correction of, or deletion of personal information by emailing [email protected] with the subject line "Privacy Request." We may verify your identity and may retain information where permitted or required for orders, refunds, adjustments, chargebacks, fraud prevention, security, taxes, accounting, disputes, legal obligations, and enforcement of our agreements.
• Request account deletion by emailing [email protected] with the subject line "Account Deletion Request."
• Unsubscribe from marketing emails using the email's unsubscribe link.
• Stop marketing text messages by replying STOP.
• Revoke precise-location or push-notification permissions through your device settings.
• Use browser, device, advertising-platform, or industry controls to limit targeted advertising.

We will process requests as required by applicable law. We may also honor requests voluntarily when reasonably feasible.

10. Data Retention

We retain personal information for as long as reasonably necessary to provide the Service and for legitimate business and legal purposes, including order fulfillment, records concerning optional tips or gratuities, payment records, customer support, refunds, adjustments, chargebacks, fraud prevention, security, taxes, accounting, disputes, and enforcement of our agreements.

When information is no longer reasonably needed, we delete or deidentify it in accordance with our retention practices.

11. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Information transmitted between your device and the Service is protected using encrypted connections where supported. No transmission or storage system can be guaranteed to be completely secure.

12. Third-Party Services

The Service may link to or integrate with third-party payment providers, delivery and fulfillment providers, fulfillment-technology providers, maps, social networks, app stores, advertising platforms, and other services. Those third parties may process information under their own terms and privacy policies.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last updated" date indicates when it was revised. If we make material changes, we will provide notice through the Service, by email, or as otherwise required by law. Where additional consent is required, we will request it separately.
